Last week, the US Supreme Court in a landmark 5-4 holding in PLIVA v. Mensing ruled that claims against generic drug manufacturers were preempted by federal law.

In essence, the court ruled that users of generic drugs (as opposed to brand name pharma products) have absolutely no legal recourse in the Federal courts. Regardless of the injury or the culpability of the manufacturer, such claims are barred. This is tort reform madness at its very worst.

It was a sad day for American consumers to say the least.

If there is a silver lining to this decision, it is that there is now an opportunity to test the “innovator liability” case of Conte in the state of California to hold the developer manufacturer of the brand product accountable for injuries sustained while taking generic versions of the drugs.
